This class will discuss defamation law in Rhode Island. Defamation may include libel and slander. Libel is defamation by written or printed words. Slander is spoken defamation. Any living person or company may be defamed. Defamatory statements adversely reflecting on a person’s ability in his business, profession, or trade are of particular concern. Statements that a company or person is dishonest or lacks the requisite skill to perform a profession or carry out an office are examples of this slander per se category. Under the typical negligence standard, in order to succeed the private person or company must prove that the defendant acted unreasonably by failing, for example, to investigate before making or publishing a statement, misinterpreting documents, or relying on dubious sources.
